Beecher Hill - House Rules 1 BEECHER HILL CONDOMINIUM 2248 Ontario Rd NW, Washington, DC 20009 House Rules Effective as of: November 17, 2023 These house rules are supplemental to and not in lieu of provisions governing which are set forth in the Declaration and By-Laws of the condominium. Payment and Collection 1. The monthly assessment is due on the 1st day of each month. Payments not received in full by the close of business on the 15th day after the due date are considered late and will be charged a $50 late fee. 2. The Association will also charge the maximum amount of interest permitted by the Condominium Instruments and/or DC law on unpaid assessments and shall pass on to unit owners the attorneys’ fees and costs the Association incurs associated with attempts to collect assessments. 3. Units that are delinquent in the payment of assessments may be referred without delay to the Association’s attorney for further action. The Association may also instruct the attorney to file a notice of a condominium lien on the subject Unit/owner, commence foreclosure proceedings and/or file suit against the delinquent owner. General 4. Unit owners must provide the Board in writing with, and keep the Board reasonably updated in writing, with respect to their contact information, to include mailing address, email address, and telephone number. 5. No occupant shall make disturbing noises, or do anything that would interfere with the rights, comforts, or convenience of other owners or occupants at any time. No musical instrument, radio, TV, computer, stereo, or the like shall be played at a noise level that disturbs or annoys others. 6. For all residents (owners, their guests, renters, etc.), quiet hours in building common areas (defined as General Common Elements in the Plats and Plans), i.e. hallways, the inner courtyard, etc., are before 7:00am and after 10:00pm Sunday-Thursday and before 9:00am and after 11:00pm Friday-Saturday. (Consistent with Bylaws section 9.5, Noise) 7. For all residents (owners, their guests, renters, etc.), building-wide quiet hours are before 7:00am and after 11:00pm Sunday-Thursday, and before 9:00am and after 12:00am Friday-Saturday (defined as music/noise that is disruptive in other people's units). (Consistent with Bylaws section 9.5, Noise)
Beecher Hill - House Rules 2 8. No occupant shall install or operate any additional major electric appliances nor permit to be brought into the building any flammable or explosive materials or potentially hazardous articles without the prior written approval of the Board. 9. Nothing shall be done or kept in the building or other common areas, or in the Unit, or that may increase the rate of insurance of the Association. 10. For all residents, smoking and vaping is prohibited, including in building common areas (GCEs) and inside the walls of Units. 11. For all residents, lock boxes on the front of the building are prohibited. Any lock box that is found on the front of the building will be removed within 10 calendar days at the expense of the Occupant who owns the lock box. An exception will be made to this should a resident be in the process of selling their unit and require the use of a lock box during the sale period. Common Areas 12. All occupants are entitled to use of the building common areas, which are defined as General Common Elements in the Plats and Plans, and include the hallways and stairways located inside and outside of the building, the inner courtyard, and the bike storage closet located beneath Unit 5’s patio. 13. Occupants acknowledge that the use of the bike storage closet is primarily for bikes and common general maintenance supplies (ladder, shovels, snow ice, etc.). Additional items (i.e. courtyard furniture) must not inhibit bike or maintenance item storage. If they do and a complaint is filed, additional items must be removed within seven (7) calendar days of the complaint. 14. Occupants acknowledge that the bedrooms of all Units, aside from Unit 1, face into the inner courtyard; therefore, Occupants shall minimize disruption, including lights, sounds, etc., when using the space. 15. Hallways and stairways located inside and outside of the building, as well as the parking area behind the building, are not to be obstructed or used for storage or party purposes other than for access to and from the Units. 16. Any damage to the property of others, or to the Common Elements, resulting from the moving and/or carrying of articles, running of water, or problems with plumbing or other facilities originating within a Unit shall be the responsibility of the owner of that Unit’s owner. Occupants must maintain and/or replace water shut-off valves and appliances. 17. No obnoxious or offensive activity shall be carried out in any Unit or common area, nor shall anything be done which may be or become an annoyance or nuisance to other occupants, including, but not limited to, allowing smoke, odors, loud noises, liquids and/or other elements to interfere with another Occupant’s enjoyment of his/her Unit.
Beecher Hill - House Rules 3 Emergencies 18. In case of fire or other emergency in your Unit or elsewhere in the building, call the fire department at 911, and call the unit owner if you are not the unit owner, and contact the Board. If necessary, leave the Unit and close but do not lock the door. Leasing Units 19. Unit owners must notify the UOA if interested in leasing their unit for any period of time, and must provide lease documents upon request to the UOA. Apartment leases must be approved by the Board before executing lease agreements with potential tenants. 20. Unit owners must notify the UOA board within five (5) calendar days of a renter’s request to move out and at least fourteen (14) calendar days before the owner is moving out/renter or long-term guest is moving in. 21. Any long-term (more than 6 months) guests or tenants must be provided with, and sign, the Association’s Bylaws and community rules before moving into the building. 22. All leases must be in writing. An owner may not lease a unit for less than one year. No unit shall be used or rented for transient, airbnb-type, hotel or motel purposes. 23. A unit owner leasing his/her/their unit must provide the Board with a fully executed copy of the lease, including the Lease Addendum enclosed with the Bylaws and these Rules, within five calendar (5) days after the lease is executed. The unit owner must also provide the Board, also within five (5) calendar days after the lease’s execution, with the tenant’s full name, email address, and telephone number. 24. Unit owners require tenants to carry their own insurance with certificates of insurance provided to the unit owner. 25. The total number of units that can be rented for more than 3 months at any one time shall be limited to 3 of the 9 units (33%), to be approved by the Board. (Consistent with Bylaws section 9.14, Leasing) Pets 26. No more than two pets are permitted in the unit, with pets subject to a weight limit of 60 lbs unless otherwise approved by the Board. Pets are limited to dogs and cats. 27. Occupants are responsible for any damage caused by their pets and pets must be accompanied by their Owners and detained by a leash when outside of a Unit or dog area. Occupants shall indemnify and hold the Association and its Board harmless against loss or liability for any actions of any pets. 28. Occupants must ensure that their pets do not disturb other Occupants.
Beecher Hill - House Rules 4 Key Policy and Unit Entry 29. The Board is authorized to enter a unit for routine building services only with written or verbal consent of the Owner with at least 48 hours’ notice, except however, in the case of emergency (example, flooding, fire or imminent danger to Occupants, the Units or the Common Elements). Move-Ins and Move-Outs 30. All moves in or out of the building must be conducted between the hours of 9:00 a.m. and 5:00 p.m., and only with the prior written approval of the Board. 31. The move-in/move-out fee is $300. It covers both the $150 move-in fee and the $150 move-out fee. The entire amount is collected up front for administrative efficiency. The owner’s account will be charged for all moves whether it is for the owner’s move or their tenant’s move. It will be the owners’ responsibility or option to then collect the $300 from the tenant if they wish to do so. 32. Unit owners shall reimburse the Association for the actual costs of any breakage or other damage caused when Occupants move in or out of their Units. Board Participation 33. All unit owners are expected to meaningfully participate in the wellbeing of the UOA either by serving on the Board, or by contributing $200 per year per unit on years they do not serve. a. The $200 fee will be levied in the January following Board elections. b. The fee will go directly to the building's reserve fund. 34. At least one member of the previous Board is encouraged to serve on the Board the following year in order to ensure consistency. Enforcement of House Rules 35. Violation of the house rules will be resolved through the following system: a. A violation is defined as a complaint by a unit owner or occupant against another unit owner or occupant for violating any of the provisions outlined in the Bylaws or House Rules. b. Unit owners or occupants must notify the Board in writing via email of a violation. After two notifications, the Board will issue a formal warning in writing via email to the offending unit owner(s). Note that in the event of a violation against tenants, guests, or occupants, the warning will be issued to the unit owner on their behalf. c. After a formal warning has been issued, a fine of $100 per additional violation will be levied to the unit owner(s). Note that in the event of a violation against
