3 1 INTRODUCTION 1.1 Who We Are Dignity for Children Foundation (Dignity) is a registered foundation with Companies Commission of Malaysia. Dignity operates various education programs and projects for the underprivileged children with the aim of “Transforming the Poor through Quality Education”. Vision: to empower underprivileged children to break the cycle of poverty through quality education, positively transforming their lives and the lives of the community around them. Mission: to establish high-quality, one-stop community learning center’s for the poor; implementing specialized learning environments which develop children academically and socially, empowering them to become productive members of society. A child, hereafter referred to an individual who is below 18 years old in accordance to the Malaysian law. 1.2 Purpose of the Child Protection Policy and Procedures (C3P) Dignity recognizes its duty to protect and ensure the safety of children, staff and volunteers and provide them with the highest possible standard of care. Dignity is committed to develop and implement policies so that everyone in the organization accepts their responsibilities to safeguard children from any harm and abuse. This means to follow procedures to protect children and report any concerns about their welfare to appropriate authorities. The paramount importance of the C3P is to protect the Rights & Safety of the children. It also provides guidelines and procedures for the staff, volunteers at Dignity to exercise their rights to protect children from any harmful situation against the children in our setting. The aim of the policy is to promote good practice, provide children with appropriate safety/protection while in the care of the organization as well as to allow staff and volunteers to make informed and confident responses to specific child protection issues.
4 1.2.1 The following are the purposes of the policy: a. Dignity for Children Foundation has a Child Protection Policy to show its full commitment to the protection of children from being harmed, exploited and abused. It also complies to the objective that every child enrolled at Dignity has the rights to survival, protection, development and participation all of which are in line with the CRC b. It is to provide a framework of child protection for all of Dignity for Children Foundation associates, including staff, directors, board members, corporate partners, civil society, volunteers and all who work with children in the organization c. The policy document aims to educate all who read the C3P about the types of abuses and neglect of children and to educate and promote a child friendly society and environment where all are committed to upholding the child’s rights and safety. d. The C3P can lead to a well informed and open environment where any concerns about the safety and wellbeing of the child can be raised and managed correctly, efficiently and fairly, without the child’s rights being violated. e. The C3P adheres to laws concerning the safety and wellbeing of the child which applies to but is not limited to sexual abuse, neglect, mental / emotional abuse, physical abuse, child trafficking, child sexual grooming and child smuggling 1.2.2 The instruments adopted for the operation of child protection in Malaysia are as follows: a. The United Nations Convention on the Rights of the Child (signed and ratified by Malaysia in 1995)(www.unicef.org/crc) b. Optional Protocol – Sale of Children, Child Prostitution and Child Pornography (Malaysia has not adopted this protocol) (www.unhchr.ch/html/menu2/dopchild.htm) c. The Child Act 2001 d. Anti-Trafficking in Persons & Anti-smuggling of Migrants Act (Amendment) 2007 e. Penal Code f. National Child Protection Policy g. Sexual Offences Against Children Act 2017
5 1.2.3 Dignity adopts this Child Protection Policy to ensure that every parent, staff, Trustee, volunteer and donor: Are aware: a. of their responsibility in safeguarding children who are studying or engaging in activities at Dignity for any and the entire given period. b. of child abuse and neglect issues and how to identify a child who is at risk or being harmed. c. and be confident that all Child Protection concerns and referral are handled confidentially, professionally and without biases to prioritize the safety and rights of a child Are indefinitely aware: a. of the procedures to be followed should there be ANY concerns. b. about the expected high risk behaviors that might warrant a referral to the child protection coordinator c. that referrals are mandatory if there are any concerns whether or not you deem it as relevant. It will not be based on personal opinions and biases. d. And fully support Dignity’s commitment to provide a safe and healthy environment for the child’s development in compliance to Dignity’s core values and philosophies regardless of personal culture, tradition and perception 1.2.4. Dignity aims to protect children by the following ways, but not limiting to: Ensuring all staff and volunteers are familiar with Child Protection Policy and Procedure through: a. Center Audit – inspections and interviews conducted once a year by external agencies such as UNHCR and/or World Vision. b. Staff agreement – having all staff and volunteers to review the Child Protection Policy with the HR Personnel and sign after reviewing to agree that they have read and understood the policy annually. By consenting to the child protection policy all staffs will commit to staying updated with the latest child protection policies at Dignity by attending ALL trainings and/ or checking with a superior. c. Staff Training will be conducted annually by the Child Protection Coordinator and Dignity’s Welfare and Community Development Department. This training is mandatory for all departments. It is the responsibility of all HOD’s to ensure staffs in their respective department will attend the training. d. Selection of staff – Ensuring that all staff and volunteers adhere to Dignity’s recruitment processes and is supervised during their entire service. Supervisors should screen candidates for any red flags instinctually or otherwise. e. Review of C3P – Having the Child Protection Policy and Procedure reviewed once every
