Himachal Pradesh National Law University, Shimla Semester -II Academic Session 2024-2025 Paper Code-LB-203 Page 1 Constitutional and Legal History Course Outline: This Course offers an in-depth exploration of the constitutional and legal history of India from the early modern period to the dawn of independence in 1961, tracing the evolution of governance structures, legal systems, and constitutional principles amidst the backdrop of colonial rule, socio-political movements, and cultural transformations. It delves into the rich tapestry of India's legal heritage, beginning with the arrival of European powers in the early 17th century and the establishment of colonial legal frameworks that laid the foundation for British dominance over Indian governance. Through a chronological journey, the syllabus examines key milestones such as the establishment of the East India Company's rule, the codification of Hindu and Islamic law, the advent of British constitutional reforms, and the emergence of Indian nationalist movements advocating for self-governance and constitutional reforms. Moreover, it critically analyzes the interplay of colonial legislation, indigenous legal traditions, and socio- political dynamics, shedding light on the complex negotiations between colonial authorities and Indian elites, as well as the struggles for justice, equality, and sovereignty among diverse communities and social groups. By contextualizing legal developments within broader historical narratives, this syllabus seeks to deepen students' understanding of the multifaceted forces that have shaped India's constitutional and legal landscape, fostering critical thinking skills and encouraging engagement with the complexities of India's journey towards independence and nationhood. Course Objectives: The primary objectives of this course are:- 1. Explore the historical evolution of governance structures and legal systems in India from 1600 to 1961. 2. Analyze the impact of colonial rule on India's legal and constitutional development. 3. Examine the intersection of indigenous legal traditions with European legal frameworks during the colonial period. 4. Investigate key legislative enactments, judicial decisions, and constitutional reforms during this period.

Understand the role of socio-political movements and nationalist struggles in shaping India's constitutional and legal history. 6. Critically evaluate the dynamics of power, authority, and sovereignty within colonial and post-colonial legal frameworks. Learning Outcome: The learning outcomes of this course are:- 1. Understand the historical evolution of governance structures and legal systems in India from 1600 to 1961, including the roles of various ruling powers such as the Mughals, British East India Company, and the British Crown. 2. Analyze the impact of colonial rule on India's legal and constitutional development, evaluating changes in legal structures, administration, and governance imposed by the British. 3. Examine the intersection of indigenous legal traditions with European legal frameworks during the colonial period, assessing dynamics of adaptation, resistance, and hybridization. 4. Investigate key legislative enactments, judicial decisions, and constitutional reforms during this period, identifying their significance in shaping India's legal landscape. 5. Understand the role of socio-political movements and nationalist struggles in shaping India's constitutional and legal history, including the influence of figures like Mahatma Gandhi, Jawaharlal Nehru, and B.R. Ambedkar. 6. Critically evaluate the dynamics of power, authority, and sovereignty within colonial and post-colonial legal frameworks, considering issues of representation, rights, and justice. Pedagogy: A Multifaceted approach to engage student actively in their learning journey will be used. It combines traditional methods such as lectures for providing foundational knowledge with interactive activities such as case study analysis, group discussions, debates and simulations to encourage critical thinking and application of concepts. Additionally, experiential learning opportunities such as field visits and internships offer practical insights into the functioning of the legal system and the development of the legal profession. Through a combination of formative and summative assessments, regular feedback, and reflective practices, this pedagogical approach aims to foster a deep understanding of the evolution of
