Contact No.9999999xx. I the undersigned file the following complaint against Mr. Akshay Kumar as under: 1. That I am the authorized executive of the above said company and I am competent to file the complaint. That Mr. Akshay Kumar made an application for the post of Project Manager in our company vide his application dated 10.11.2024. That upon scrutiny of the Curriculum Vitae, and personal interview the company was pleased to confirm the offer made by Mr. Akshay Kumar for the post of Project Manager vide its offer letter dated 16.11.2024. The copy of the offer letter is herewith enclosed. 2. That the offer letter followed security policy of the company which is duly accepted and signed by Mr. Akshay Kumar. The said
security policy is herewith enclosed. That Mr. Akshay Kumar joined the company on 10.01.2025 in pursuance to the offer letter of the company and was discharging his duties. 3. That all of a sudden the said employee’s performance was not up to the satisfaction of the company and we had suspicion on the integrity of the said employee and also it came to the notice of the Management that the said employee was acting contrary to the terms of offer letter by misusing the source code, an intellectual property of the company during the employment and was disclosing the confidential information and breached the terms of employment agreement. Besides the said employee has conducted himself in an unethical manner by soliciting the clients of the company, contrary to the interest of the company and has thereby caused huge monetary loss to the company and also committed breach of trust. 4. That apart the said employee has shared the knowledge acquired from the Company with the third party entities and thereby has induced the company clients to part with our company and has taken up their job without the knowledge of the company, which is a very serious offence. One such specific condition is that the employee shall not take up any independent or individual assignments either part time or full time or in advisory capacity or otherwise directly or indirectly without the express written consent of the company. Further the employee is not supposed to work for gain or attend privately any of the Softech customers to whom the reference of the employee is provided and shall not have any business or service related relationship with the customer of the company. That Mr. Akshay Kumar has wilfully and with full knowledge has contravened the aforesaid employment conditions and has solicited the work from M/s. Starlight Solutions of Mr. James J. Malcolm and has sought personal
