If,brac MATERNITY BENEFITS POLICY 1. Policy Brief & Purpose BRAC is committed to provide a supportive environment for its staff, and thus is engaged towards offering benefits that ensure the rights of all staff. BRAC Maternity Benefits Policy comprises of guidelines ensuring the minimum standards and provisions to be applied across the organisation to strengthen support to newborns and mothers. 2. Scope This policy applies to all regular, service (graded and non-graded), and contractual (project and fixedterm) women staff. 3. Policy Elements Maternity leave is a temporary absence from a staff's position and applies to expectant or new mothers who require time off from work for pregnancy, physical recovery and child care. 4. Maternity leave with pay l. Regular and Service (graded and non-graded) staff shall work for a minimum six (6) months from the date of joining for the entitlement of maternity leave with pay. ll. Contractual (project & fixed term) staff will be entitled to maternity leave with pay provided her current contract period is minimum one year and she has already worked for at least six (6) months. However, the duration of the maternity teave with pay will not exceed the period of her current employment contract. lll. Staff can avail maternity leave with pay for a period of maximum 180 continuous days including minimum two (2) months after delivery. lV- Staff will receive salary on a monthly basis during the period of maternity leave with pay. V. No such benefit shall be payable to the staff if at the time of her delivery she has I -/K two (2) or more surviving children including adopted child/ children. Vl. ln case of stillborn (more than 7 months - prior delivery), staff will be entitled to leave with pay and may choose to avail maximum two (2) months leave from the date of the incident. Vll. ln the unfortunate event that the child dies during or within six months after birth, the staff is entitled to the full duration of maternity leave with pay to help her recover medically and emotionally from the loss. Vlll. Staff can avail maternity leave with pay for three (3) months in case of adoption. No such benefit shall be payable to the staff if during the time of adoption, she has two (2) or more surviving children including adopted child/ children. lX. ln case staff dies during maternity leave, being entitled to maternity leave with pay, BRAC will pay the balance/ due amount of staffs gross salary for the remaining period of the maternity leave either- - to the person nominated by her, or - to her legal representative if there is no nominee X. Staff can avail maternity leave without pay for a period of maximum 180 continuous days after enjoying maternity leave (with pay) in case of necessity or complexity. ln case staff needs to take the leave after joining from maternity leave (with pay), she may avail annual leave or without pay leave (if annual leave is not available) which will be approved according to the table of authority. The period of seniority loss would be applicable as per the HRpp. Xl. Staff availing maternity leave with pay will be subjected to the benefits irrespective of her job separation by means of discharge, termination, dismissal, retrenchment or redundancy. 5. Maternity leave without pay il Staff who has not worked for six (6) months after joining as regular or service (graded and non-graded) can avail maternity leave without pay. Contractual (project & fixed term) staff can avail maternity leave without pay if she has not worked for six (6) months and/ or the duration of her current contractual period is less than one (1) year. However, the duration of maternity leave without pay will not exceed the period of her current employment contract. Staff will be entitled to maternity leave without pay instead of maternity leave with pay if at the time of her delivery she has two (2) or more surviving children including adopted child/ children. Staff can avail maternity leave without pay for a period of maximum 180 continuous -rd days including minimum two (2) months after delivery. IV
ln case of stillborn (more than 7 months - prior delivery) or in any unfortunate event that the child dies during or within six months after birth, staff will also be entitled to maternity leave without pay and may choose to avail up to two (2) months leave from the date of incident. Vl. The provision of seniority loss would be as per the HRPP. 6. Miscarriage ln case of Miscarriage (from the conceive date to the end of the seventh month), staff will be entitled to 15 days of accidentrl 1""r" with pay from the date of incident. (Please refer to Accidental or surgery-related leave policy in HRPP). 7. The following rules will apply to maternity Ieave with and without pay: l. No staff shall be allowed to work during the immediate two (02) months after delivery. ll. During the period of maternity leave, the organisation may fill the position with a temporary replacement, or the job responsibilities might be shared by others. Procedure: Staff has to apply for maternity leave in the prescribed leave application form at least one (1) month prior to the starting date of maternity leave. However, if a staff cannot give any such notice due to emergency, she shall inform her respective supervisor about her giving birth to a child by giving such notice within seven (7) days of her giving birth to the child. ll. Approval a. For Maternity Leave with/ without pay, staff has to obtain leave approval from respective supervisor. , b. For extending Maternity Leave without pay (not more than 180 days), staff has to obtain leave approval from second supervisor. However, respective Programme/ Enterprise Director will hold the highest authority for this type of approval. c. Any leave in addition to Maternity Leave without pay will be considered as annual leave or leave without pay and will be approved according to the table of authority. Staff has to ensure that the approved application is submitted before/ after (within 7 days, in case of emergency) the leave - to respective HR (for head office) - to field HR and field accounts officer (for fietd office) lV. Staff has to submit the appropriate legal documents of adoption along with leave application. V. Staff has to submit.the necessary documents supporting the case (pregnancy, miscarriage, stillborn, other complications). Vl. Staff has to notify her respective supervisor in writing to extend the leave at least one (1) month prior to the end date of the maternity leave. 8. Policy Review The Maternity Benefits Policy is subjected to be reviewed every two (2) years. However, if deemed necessary, the policy may be amended/ changed/ reviewed any time in response to changes in the legislation of the country and or as per the necessity of the organisation.
