M.C. PETITION Facts of the case: Smt. Lakshmi and Sri. Krishna got married on 17.04.2021 as per the Hindu religious rites and customs at SLV Convention Hall, Jayanagar, Bengaluru. The said marriage was an arranged marriage and held as per the wishes of the elders in both the families. After the marriage both of them started living together at Krishna’s house at J.P. Nagar, Bengaluru. There are no issues between Lakshmi and Krishna. At the time of marriage Krishna was working as a software engineer and earning a handsome salary of Rs.1 Lac per month. Lakshmi is also an MBA graduate but not working at the time of marriage. After few months of marriage Krishna left his job and took to gambling and alcoholism for reasons best known only to him and started harassing his wife Lakshmi. Since Krishna didn’t have an income Lakshmi started working and managed the household out of her earnings. Krishna frequently insisted on Lakshmi to bring more dowry from her parents and when she didn’t oblige, he shouted and threw household items at her and sometimes he also physically abused her by hitting and kicking her. On one occasion Krishna threw his laptop at her which nearly missed damaging her left eye. Lakshmi tolerated this abusive behavior of Krishna and continued to grin and bear the ordeals meted out by him. Moreover, Lakshmi’s in-laws also deliberately overlooked the plight of Lakshmi as they did not raise any objections to their son’s misbehavior at home. Subsequently, when the physical torture and mental abuses became unbearable Lakshmi left her matrimonial home and returned to her parents’ home and started living with them from 18.10.2022. After this Krishna rarely visited Lakshmi but even when he visited, he harassed and abused her in front of her parents. Finally, Lakshmi has decided to put an end to the marriage as it has irretrievably broken down. Towards this end she has requested her husband to opt for a decree of divorce by mutual consent but the same has been consistently deferred by him. Hence, she has decided to file an MC petition and obtain a decree of divorce. Problem: Draft an MC petition on behalf of Lakshmi praying for the dissolution of marriage on the grounds of cruelty and desertion, solemnized on the date aforementioned and to be filed before the Principal Judge, Family Court, Bengaluru and also include an Interlocutory Applications under section 24 of the Hindu Marriage Act, 1955 and Section 13 of Family Courts Act, 1984.
