THE INSTITUTION OF CRIMINAL PROCEEDINGS 1. Criminal Prosecution “Criminal Prosecution” refers to the instituting of criminal proceedings against an offender in a Court of Law. The presentation of such cases may be undertaken by: (a) Court Prosecutors (Police Officers) (b) State Attorneys (c) Attorneys in private practice where the fiat of the Director of Public Prosecutions is obtained.
