2.0 ROAD TRAFFIC ACCIDENTS SO No. 44, Motor Vehicle and Road Traffic Control, Investigation and Procedure DEFINITION Sec. 27 Road Traffic Accident Road Traffic Accident refers to a collision on a road involving traffic, which results in damage to vehicle(s) and property or causing injury and/or death to persons and/or animals. Sec. 33 Mode of Reporting Accidents A road traffic accident can be reported by the driver of a motor vehicle to the police in the following manner: (a) To a police officer in uniform: (i) At the time and place of the accident; (ii) On patrol in the vicinity of the accident; (b) To a police officer at a police station either: (i) In person; (ii) By telephone; or iii) By any other person on his behalf. _________________________ TYPES OF ACCIDENTS Trivial Accident Refers to road traffic accident where there is no injury to persons but the damage to vehicles and property is minimal and there is no serious breach of traffic laws (SO 44:30). Serious Accident Refers to a collision on a road, which results in injury to persons and/or animals or serious damage to property (SO 44: 28). Fatal Accident Refers to a road traffic accident resulting in the death of a person (SO 44:29). Government Vehicles Refers to vehicles owned by a ministry of government department such as Defence Force, Prisons, Fire Service, Ministry of Health, Ministry of Works, Ministry of Education, but does not include a vehicle owned by a statutory board such as the Water and Sewerage Authority, Telephone Service of Trinidad and Tobago, Public Transport Service Corporation, etc. (SO 44:31). particulars of his driving permit and the name and address of the owner of the vehicle; (c) unless a report is made by the driver at the time and place of the accident to a member of the Police Service, the person riding in, driving or in charge of the vehicle shall proceed with all proper dispatch to the nearest police station or police constable in uniform and shall report the accident, and shall give his name and address and the name and address of the owner of the vehicle and the names of any persons in the vehicle at the time of the accident. (2) Any person who contravenes this section is guilty of an offence. NOTE: By virtue of Section 79 Chapter 48:50, all drivers involved in road traffic accidents (RTA) must report the matter either to the police on the spot, or at the nearest police station, or to the police constable in uniform.
