3 FACTS OF THE CASE 1. That the Petitioner is a brilliant student and hails from a respectable family. The father of the Petitioner is a well-known surgeon and practicing medicine in the state of Bihar. The Petitioner in order to continue the same medical practice and to join his father has opted to pursue his career in medicine. Accordingly with this idea, the Petitioner has successfully completed his pre-qualification examination in 1 st class. The Petitioner appeared for the All India Entrance Examination conducted by the 1 st respondent for admission to the MBBS course for the academic year 2001-02. The Petitioner stood 74 th rank in the said examination and has secured admission for the 1 st year MBBS course by remitting the requisite fee under the 2 nd respondent college on 27-08-2001, vide Roll No. 010101068. 2. That the Petitioner after joining the 2 nd respondent college and hostel, because of the unconducive atmosphere could not complete all the subjects in the 1 st year MBBS and as such he was not promoted to the 2 nd year MBBS. That for the reason of the change in the environment, the Petitioner could not seriously pursue his studies and also because of certain unscrupulous elements in the hostel, the Petitioner was dragged into various controversies. The seniors of the Petitioner have used brutal force on him and the Petitioner being innocent and an outsider was made a scapegoat to the acts done by his seniors and room-mates. In this regard, the 2 nd respondent has taken undertaking from the Petitioner for the illegal acts committed by his room mates and seniors and recorded his confessional statements. The Petitioner was forced to do so in order to buy peace and to continue his studies in the 2 nd Respondent’s institution. 3. That the Petitioner and his father though tried to seek for transfer of Petitioner from the 2 nd respondent institution to another institution within India, but the statute did not permit them to do so, unless and until the Petitioner completes the 1 st year MBBS course. The Petitioner unwillingly was compelled to continue his studies in the 2 nd respondent institution. The Petitioner had also not attended the examination and classes. The Petitioner was also dragged in two Criminal cases along with his seniors and room mates, which were instituted by the Manipal Police in C.C. No. 5404/2005 and C.C. No. 5405/2005, both of which ultimately culminated in acquittals. These false and frivolous allegations made against the Petitioner by the hostel warden, suspicious look by the teaching staff, harassment by his seniors and some of the teaching staff has caused severe
