INTRODUCTION: The Twelve Tables of Roman Law stand as a remarkable pillar in the history of legal systems. These ancient laws, created over 2,400 years ago, have left an enduring impact on how societies establish rules and justice. 2. BACKGROUND: In ancient Rome, people needed clear laws to guide their lives and ensure fairness. However, the laws were known only to a few, leading to confusion and unequal treatment. To address this, the Roman leaders
decided to create a set of laws that would be publicly displayed for everyone to see, ensuring transparency and equality. 3. THE TWELVE TABLES: The Twelve Tables were a set of written laws inscribed on twelve bronze tablets. These laws covered various aspects of Roman life, from family matters to property disputes and criminal offenses. They were created around 450 BCE and became the foundation of Roman jurisprudence. 4. WHAT WERE THR TWELVE TABLES OF ROMANS: The Twelve Tables, also known as the "Lex XII Tabularum" in Latin, were a set of laws that formed the foundation of Roman civil law. These tables were the result of a significant development in Roman legal history, as they represented the first written code of laws in Rome. The creation of the Twelve Tables occurred around 450-449 BCE in response to a demand for greater transparency and consistency in legal matters. • Table I: (Proceedings Preliminary to Trial) This table dealt with legal procedures, including rules for bringing lawsuits, appointing judges, and giving the defendant a set period to respond to a summons. • Table II: (Trial) This table focused on legal proceedings and regulations for property rights, such as rules about ownership and possession of property. • Table III: (Execution of Judgment) Table III contained laws related to debt and economic matters. It established the principle that debtors who could not repay their debts could be put into servitude. • Table IV: (Paternal Power) This table covered matters related to family and guardianship, including rules about marriage, divorce, inheritance, and the rights and duties of fathers over their children. • Table V: (Inheritance and Guardianship)
Table V dealt with issues of inheritance and inheritance rights. It specified the order of inheritance and the rights of different family members in case of intestate succession (when someone dies without a will). • Table VI: (Ownership and Possession) This table contained regulations regarding property and ownership rights, particularly in regards to land and boundaries. • Table VII: (Real Property) Table VII included rules about land rights and torts (civil wrongs or injuries). It laid out regulations for handling cases involving damage to property, including rules for compensation. • Table VIII: (Torts or Delicts) This table covered regulations related to public law and religious matters.
