P.K.Raghavendra Gupta & Ors Accused APPLICATION UNDER SECTION 436 OF THE CODE OF CRIMINAL PROCEDURE, 1973 / SECTION 478 OF THE BHARATIYA NAGARIK SURAKSHA SANHITA, 2023 The Accused No.1 to 3 beg to submit as under:- 1. The complainant has filed a false and frivolous complaint against the accused for the alleged offences punishable under Section 19(1) of the Seeds Act, 1966. The accused are innocent of the alleged offence. 2. That the said offence is bailable in nature. That the alleged offence is neither heinous nor punishable with death or life imprisonment. That the accused are businessmen by profession and are law abiding citizens and permanent residents of Bengaluru. The accused have not committed any offence as alleged by the Complainant. 3. The accused hail from respectable family and have deep roots in the society. The accused are depending upon the earning from the said business and it is the only source for their livelihood. If the accused are not enlarged on bail, it will cause great damage to their reputation in the society. If the accused are enlarged on bail the Complainant will not suffer any loss or injury. 4. The accused are solvent. The accused undertake to appear before this Hon’ble Court and will comply with the terms and conditions that may be imposed by this Hon’ble court for their enlargement on bail. Since the alleged offences are bailable in nature, the accused may be enlarged on bail on self bond. WHEREFORE, the accused No.1 to 3 most humbly prays that this Hon’ble Court be pleased to allow the application by enlarging the accused on bail, in the interest of justice and equity.
